La gestación subrogada: Análisis doctrinal, legal y jurisprudencial

Abstract

La gestación subrogada es uno de los asuntos más controvertidos en el panorama jurídico y social actual, suscitando intensos debates éticos, legales y doctrinales. En este trabajo analizaremos en profundidad el concepto y las modalidades de esta práctica, su evolución histórica, así como las partes implicadas. A su vez, expondremos los principales desafíos que plantea a nivel ético y jurídico, y examinaremos la normativa española al respecto, con especial atención en la Ley de Técnicas de Reproducción Humana Asistida. Por último, nos centraremos en las resoluciones más relevantes de la Dirección General de los Registros y del Notariado, y realizaremos un repaso de la jurisprudencia tanto del Tribunal Supremo como del Tribunal Europeo de Derechos Humanos.

Surrogacy remains one of the most controversial issues in the current legal and social context, giving rise to intense ethical, legal, and doctrinal debates. This dissertation offers a thorough analysis of the concept and various forms of this practice, its historical evolution, and the parties involved. It also addresses the main challenges it presents and examines the Spanish legal framework in this area, with particular emphasis on the Law on Assisted Human Reproduction Techniques. Finally, the study focuses on the most significant decisions issued by the Directorate-General for Legal Certainty and Public Faith, and provides a review of the relevant case law of both the Spanish Supreme Court and the European Court of Human Rights.
