DELITOS CONTRA LOS DERECHOS DE LOS TRABAJADORES

Abstract

En este Trabajo de Fin de Grado se analiza la regulación de los delitos tipificados en el Título XV, del Libro II, del Código Penal español, cuya finalidad es la protección de los derechos de los trabajadores. Desde la Revolución Industrial hasta la actualidad, los derechos de los trabajadores han evolucionado hasta llegar hoy en día a la protección penal que se garantiza. Inicialmente, la regulación se limitaba a evitar riesgos extremos y abusos evidentes, sin embargo, con el tiempo, se incorporaron garantías sociales y de seguridad en las relaciones laborales. El objeto de este trabajo es estudiar y analizar cómo el Legislador penal español ha ido recogiendo y reforzando estas garantías en el Título XV del Código Penal, adaptándose a la realidad social, con fenómenos como la contratación irregular mediante fórmulas ajenas al contrato de trabajo o la explotación de extranjeros y menores. Se analiza también en el presente trabajo la discriminación laboral y los delitos contra la seguridad e higiene en el trabajo.

In this Final Degree Project, the regulation of the offences listed in Title XV, Book II of the Spanish Criminal Code—whose purpose is to protect workers’ rights—is thoroughly examined. From the Industrial Revolution to the present day, workers’ rights have evolved significantly, culminating in the current level of criminal protection. Early regulations focused solely on preventing extreme hazards and blatant abuses; over time, they came to encompass social guarantees and safety measures within labor relations. The aim of this study is to explore and analyze how the Spanish legislature has progressively incorporated and strengthened these protections in Title XV of the Criminal Code, adapting to social realities such as irregular hiring practices that circumvent employment contracts and the exploitation of foreigners and minors. This work also addresses labour discrimination and offences against workplace safety and hygiene.
