La gestación subrogada: derechos e intereses jurídicos en conflicto

Abstract

En España, la gestación subrogada suscita un intenso debate jurídico y social, al confrontar la normativa vigente con la existencia de menores nacidos mediante esta técnica fuera del país. Este trabajo analiza el conflicto, examinando derechos constitucionales clave: dignidad, integridad de la madre y el menor, protección familiar e interés superior del niño. Explora la jurisprudencia europea y española, modelos regulatorios internacionales y la influencia de la terminología. Destaca incoherencias normativas y propone soluciones para la inseguridad jurídica: mecanismos de filiación que no legitimen la práctica, prevención de explotación y protección integral, sin renunciar a la dignidad humana.

In Spain, surrogacy raises an intense legal and social debate, as current legislation conflicts with the reality of children born abroad through this practice. This thesis analyzes the issue by examining key constitutional rights: dignity, the integrity of the surrogate and the child, family protection, and the best interests of the child. It explores Spanish and European case law, international regulatory models, and the impact of legal terminology. The study highlights legal inconsistencies and proposes solutions to address legal uncertainty: parentage mechanisms that do not legitimize the practice, prevention of exploitation, and comprehensive protection without compromising human dignity.
