Derecho y Estado en el pensamiento utilitarista: Jeremy Bentham

Abstract

Este trabajo analiza el pensamiento de Jeremy Bentham desde la perspectiva del utilitarismo como teoría ética, jurídica y política. Se profundiza en su concepción del derecho como herramienta para maximizar la utilidad social, rechazando los derechos naturales en favor de una legislación positiva basada en la felicidad del mayor número. Asimismo, se examina su visión del Estado como mecanismo racional orientado al bienestar colectivo, así como su defensa del legislador como ingeniero social. La obra también explora la moral utilitarista, la crítica a la división de poderes y la utilidad de la religión en la cohesión social. Finalmente, se valora la vigencia del utilitarismo en el contexto actual y sus límites como teoría normativa

This paper analyzes the thought of Jeremy Bentham from the perspective of utilitarianism as an ethical, legal, and political theory. It explores his conception of law as a tool to maximize social utility, rejecting natural rights in favor of positive legislation based on the happiness of the greatest number. The study also examines his view of the State as a rational mechanism oriented toward collective well-being, as well as his defense of the legislator as a social engineer. The work further explores utilitarian morality, critiques the separation of powers, and considers the usefulness of religion in social cohesion. Finally, it assesses the relevance of utilitarianism in today's context and its limits as a normative theory
