En este trabajo se analiza en profundidad el sistema comercial de la franquicia,
desde su nacimiento en Estados Unidos y evolución en este país pionero,
hasta la llegada de esta fórmula en Europa y, con especial interés, en España.
Se describe cómo ha evolucionado la franquicia en el territorio español,
detallando cuál es su situación actual. Desde una perspectiva jurídicolegislativa,
se analiza la normativa existente en este campo en España y en
Italia, realizando un análisis comparativo de las mismas. Finalmente, para
ilustrar con claridad el marco legislativo descrito, se toman dos casos reales de
franquicia, una española y una italiana, y se realiza un análisis comparativo de
sus principales características.
This project analyses the trading system of the franchise in depth since its birth
in the United States as well as its evolution in this pioneering country until the
arrival of this commercial formula to Europe, specially focused in Spain. It is
described how the franchise has been developed in the Spanish territory,
detailing what its current situation is. From a legislative and judicial perspective,
it is analysed the existing legislation in this field in both, Spain and Italy,
performing a comparative analysis of them. Finally, to clearly illustrate the
described legislative framework, two real cases of franchise have been
described, a Spanish one and an Italian one. Besides, a comparative analysis
of its main features is performed.
