Las Reformas del Derecho de Familia durante la II República Española (1931-1939) y el Franquismo (1936-1975)

El presente trabajo tiene por objeto el análisis de las reformas en materia de Derecho de
familia acontecidas durante la Segunda República (1931-1939) y la época franquista
(1936-1975) en España. En primer lugar se muestra cuál ha sido la evolución histórica
del Derecho de familia hasta la proclamación en 1931 de la Segunda república. A
continuación, el grueso del trabajo se centra en describir las reformas habidas en esta
materia durante la Segunda República y la época franquista: a saber, la Ley de Divorcio,
la Ley de Matrimonio Civil y la Ley sobre filiación. Por último, se describen las leyes que
reforman el articulado del Código Civil Derecho de Familia.
The present essay has for its object the analysis of the reforms in Family Law that
ocurred during the Second Republic (1931-1939) and the Franco era (1936-1975) in
Spain. First of all, it shows what has been its historical evolution of Family Law until the
proclamation in 1931 of the Second Republic. Then, the bulk of the work focuses on
describing the reforms carried out in this area during the Second Republic and the
Franco era: namely, the Divorce Law, the Civil Marriage Law and the Filiation Law.
Finally, the laws that reform articles of the Civil Code of Family Law are described.
