La guarda de hecho, es una institución encargada de la protección tanto de menores,
incapacitados e incapaces incapacitados. Aparece regulada por primera vez, propiamente en
el Ordenamiento Jurídico español, con la Ley 13/1983, a pesar de ser una figura histórica
de la que se tenía constancia en el Derecho Romano. Recientemente ha surgido un mayor
interés en torno a esta figura, gracias a la reciente reforma efectuada en el Código Civil en
el año 2015, ampliándose el fondo del asunto, pese a seguir teniendo una regulación
bastante escasa, de la que actualmente se desprenden problemas que la ley no ha sabido
atajar. Conforme al trabajo que se expone en las sucesivas líneas, tiene el interés de destacar
la funcionalidad de la guarda de hecho junto a sus respectivos caracteres, el marco jurídico
de regulación en el que se encuadra, su evolución histórico-legislativa hasta llegar a la
regulación actual.
The guard of fact, is an institution in charge of the protection of both minors, incapable
not incapacitated and incapacitated. Appears for the first time properly regulated, in the
Spanish Legal System with Law 13/1983, despite being a historical figure that was recorded
in Roman Law. Recently, a greater interest has arisen around this figure thanks to the recent
reform of the Civil Code in 2015, expanding the merits of the matter, despite continuing
to have rather little regulation, which currently gives rise to problems from which the law
has not known how to stop. According to the work that is exposed in the successive lines,
it has the interest of highlighting the functionality of the guard in fact together with its
respective characters, the regulatory framework in which it is framed, its historicallegislative
evolution until reaching the regulation today.
