La gestación por sustitución, de Roma a la actualidad

Throughout the present work I will deal with the topic of surrogacy gestation based on its origins in Rome and continuing with the current situation. Despite the focus of my work being the types of surrogacy gestation in Spain and the emerging problems caused by the lack of regulation in relation in terms of determining the affiliation of children, I will also refer to the position of European Court of Human Rights (ECHR) towards this topic. In order to tackle these issues, I have taken into consideration two sources: On the one hand, Roman sources from which I have been able to set the types of surrogacy gestation existing at this time (locatio ventris or locatio conductio). On the other hand, I will analyse the current increase in the number of legal cases on this matter in recent years and the legal evolution that has unfoldin this regard. Regardingits legal nature, the conducted (resulting) analysis is essentially based on the contractual character of surrogacy gestation and these consequences. Finally, I will insist on the need to regulate this matter in Spain.
A lo largo del presente trabajo abordaré el tema de la gestación por sustitución partiendo de un análisis de esta técnica en Roma para así poder, posteriormente, afrontar la situación que nos encontramos en la actualidad. Además, pese a que me centraré en estudiar la regulación y tipos de gestación por sustitución que existen actualmente en nuestro país y los problemas que acarrea la falta de regulación en relación con la determinación de la filiación de los menores así nacidos, también haré hincapié en cuál es la postura que sostiene el Tribunal Europeo de Derechos Humanos (TEDH) al respecto. Para ello he tenido en cuenta dos marcos de referencia: por un lado, las fuentes romanas, las cuales me han permitido fijar los tipos de gestación por sustitución existentes por aquel entonces (locatio ventris o locatio conductio), y por otro lado, el incremento de casos que se han dado en esta materia en los últimos años y la evolución jurídica que ha habido al respecto. En cuanto a su naturaleza jurídica, he realizado un análisis basándome en el carácter contractual de la gestación por sustitución y las consecuencias que de ello se derivan. Además, incidiré en la necesidad de regular esta materia en España.
