A lo largo de este Trabajo de fin de Máster, realizaremos un estudio sobre la legítima, centrándonos en sus caracteres de intangibilidad, tanto cualitativa como cuantitativa, y de indisponibilidad con el objetivo de localizar aquellos mecanismos que el ordenamiento otorga a los herederos forzosos para hacer frente a las disposiciones del testador que traten de menguar su derecho legitimario. Asimismo, estudiaremos las figuras jurídicas más habituales a través de las cuales el testador trata de privar a sus herederos de sus derechos sobre la legítima como son: la desheredacióny la preterición.
Throughout this MA dissertation, we will carry out a study about the legitimate, focusing on its intangibility dispositions, both qualitative and quantitative and unavailability, with the aim of locating those mechanisms that the legal system grants to forced heirs to do, in front of the dispositions of the testator that try to wane his legitimate right. Furthermore, we will study the most common legal figures whereby the testator tries to deprive his heirs of their legitimate rights such as: disinheritance and preterition.
