El presente trabajo tiene por objeto el análisis de la figura del ofendido en el sistema procesal español haciendo mención a los derechos que posee y a las especialidades en el ámbito de la violencia de género. En primer lugar, se hace referencia a su concepto y fundamento, distinguiéndolo del perjudicado, así como a los derechos que posee. Tras ello, el grueso del trabajo se dedica a describir las características de la violencia de género prestando atención a la LO 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la Violencia de Género, así como a analizar la incidencia de la habitualidad en estas conductas y los principales problemas probatorios que se plantean en este ámbito con mención a la dispensa del artículo 416 LECrim. Por último, se abordan cuestiones sobre la materia que ha solucionado la jurisprudencia.
The present essay has for its object the analysis of the figure of the offended in the Spanish procedural system doing commendation to the rights it possesses and specialties in the field of gender-based violence. Firstly, reference is made to its concept and basis, making a distinction with the injured, as well as the rights she possesses. Then, the bulk of the work is devoted to describing the characteristics of gender violence, paying attention to the LO 1/2004, of 28 December, on Integral Protection Measures against Gender Violence, as well as analysing the incidence of habitual behaviour in these conducts and the main evidentiary problems that arise in this area, with mention of the exemption in article 416 LECrim. Finally, it addresses issues that have been solved by case law.
