Excusas absolutorias en el marco del código penal

El presente trabajo de fin de grado versara sobre las excusas absolutorias en el marco del
código penal haremos un estudio de las causas que hacen posible que el sujeto responsable
de cometer un acto antijurídico y personalmente responsable no se le aplique una pena.
En primer lugar, abordaremos de forma breve en la parte doctrinal los aspectos generales de
la teoría del delito, donde hablaremos de la concepción de delitos, los elementos generales
de la teoría del delito, dígase la acción, la antijuridicidad, culpabilidad, punibilidad etc.
En segundo lugar, se procederá a estudiar las diversas excusas absolutorias profundizando
en algunas de ellas de forma específica.
En tercer lugar, se escogerá algunas de las sentencias del tribunal supremo sobre las excusas
absolutorias, las cuales analizaremos y comentaremos.
En cuarto lugar, se realizará la conclusión del trabajo, resaltando las ideas más importantes
que hemos abordado tanto en la parte doctrinal como en la parte jurisprudencial.
En quinto lugar, se terminar con las referencias bibliográficas que se han utilizado para
realizar el trabajo, haciendo referencia específica a los autores y manuales correspondientes.
This final degree project will deal with acquittal excuses within the framework of the penal code. We
will make a study of the causes that make it possible for the person responsible for committing an
unlawful and personally responsible act not to receive a criminal offense.
In the first place, we will briefly address in the doctrinal part the general aspects of the theory of
crime, where we will talk about the conception of crime, the general elements that make up the theory
of crime, say the action, the unlawfulness, guilt, punishment, etc.
Secondly, we will proceed to study the various excuses for acquittals found in the Spanish penal code,
delving into some of them specifically.
Third, some judgments of the Supreme Court will be chosen on the acquittal excuses which we will
analyse and comment on.
Fourth, the conclusion of the work will be carried out, highlighting the most important ideas that we
have addressed both in the doctrinal part and in the jurisprudential part.
Fifth, we will end with the bibliographic references that have been used to carry out the work, making
specific reference to the corresponding authors and manuals.
