Facultad de Educación y Trabajo Social El objeto de este trabajo es acercarse una realidad social y jurídica muy compleja, la creación de lazos de filiación a través de la gestación de un embrión en el útero de una mujer que va a renunciar a sus derechos sobre el niño, en favor de otras personas. Esta práctica plantea conflictos éticos y jurídicos difíciles de resolver de manera pacífica y consensuada, entran en juego derechos fundamentales e intereses legítimos de los implicados en el proceso, el derecho de la mujer, el derecho a formar una familia, el interés del menor, la explotación de la mujer gestante, la cosificación del menor... España mantiene al respecto una postura ambigua y errática, nuestra legislación prohíbe el contrato de gestación por sustitución, pero reconoce la filiación del menor otorgando, en su caso, validez al acuerdo realizado en países extranjeros entre los progenitores contratantes y la gestante, cuando se dan determinados requisitos. La situación es de clara inseguridad jurídica para todos los implicados en esta técnica, que requiere de una regulación clara, pendiente de acción, aunque hubo una intención a través de la presentación de la Proposición de Ley ante el Congreso por parte del grupo parlamentario de Ciudadanos. The purpose of this paper is to approach a very complex social and legal reality, the creation of filiation bonds through the gestation of an embryo in the uterus of a woman who is going to renounce her rights over the child, in favor of other people. This practice raises ethical and legal conflicts which are difficult to resolve in a peaceful and consensual manner, as fundamental rights and legitimate interests of those involved in the process come into play, the right of the woman, the right to form a family, the interest of the minor, the exploitation of the gestating woman, the objectification of the minor.... Spain maintains in this respect an ambiguous and erratic position, our legislation prohibits the surrogacy contract, but recognizes the filiation of the minor granting, where appropriate, validity to the agreement made in foreign countries between the contracting parents and the pregnant woman, when certain requirements are met.
