¿Justicia transicional en transición? Estudio a partir del caso Antonio Gutiérrez Dorado y Carmen Dorado Ortiz contra España, ante el TEDH

La justicia transicional ha sido y sigue siendo un instrumento primordial para la
reconstrucción del Estado de Derecho y para perseguir las violaciones de derechos.
Los mecanismos son distintos en cada situación, y por ello este trabajo se centrará en el
Estado español, analizando un supuesto concreto, el caso Gutiérrez Dorado y Dorado y
Ortiz contra España ante el Tribunal Europeo de Derechos Humanos y valorando la
actuación de las autoridades en el contexto de la transición española, por los crímenes de
lesa humanidad y vulneraciones de derechos durante la guerra civil.
Todo eso, teniendo en consideración la legislación española del momento, así como los
estándares de verdad, justicia, reparación y no repetición, fijados de manera internacional.
Un elemento clave en cuanto a la justicia de transición y su función reparadora es la
“responsabilidad”, por lo que hay que determinar si el Estado es realmente responsable

law and for prosecuting violations of rights.
The mechanisms are different in each situation, which is why this work will be focused on
Spain, analyzing a specific case, the case of Gutiérrez Dorado y Dorado y Ortiz versus Spain
before the European Court of Human Rights, and assessing the actions of the authorities
in the context of the Spanish transition, for crimes against humanity and violations of rights
during the civil war. All this, taking into account the Spanish legislation of the moment, as
well as the internationally established standards of truth, justice, reparation, and nonrecurrence.
A key element of transitional justice and its reparative role is “accountability”, and it is
therefore necessary to determine whether the State is actually accountable
