Partiendo del reconocimiento de todas las personas del derecho a otorgar
testamento recogido en el artículo 662 del Código Civil, ha sido objeto de gran controversia
la nueva Ley 8/2021. La finalidad del presente Trabajo de Fin de Grado (en adelante, TFG)
consiste en estudiar la nueva realidad jurídica actual: el derecho de otorgar testamento por
quienes padezcan algún tipo de enfermedad física, psíquica o intelectual tras los cambios
legislativos introducidos por la Ley 8/2021. Por ello, se llevará a cabo un análisis de los
nuevos artículos 663 y 665 Código Civil concretamente en su redacción anterior y posterior
a la entrada en vigor de dicha ley.
De este modo, este trabajo gira entorno a dos ideas fundamentales que se ha
llegado en este TFG y son: la importancia y la gran responsabilidad que tiene establecida el
Notario a la hora de valorar la capacidad del testador; y, por otro lado, y la gran posibilidad
que se permite a aquellas personas que sufren una discapacidad.
Based on the recognition of all the people of the right to grant a will contained in
article 662 of the Civil Code, the new Law 8/2021 has been the subject of a strong debate.
The purpose of this Final Degree Project (hereinafter, TFG) is to study the new current
legal reality: the right to grant a will for those who suffer from some type of physical,
mental or intellectual illness after the legislative changes introduced by Law 8 /2021. For
this purpose, an analysis of the new articles 663 and 665 Civil Code will be carried out,
specifically in its wording before and after the entry into force of said law.
In this way, the aim of this work revolves around two fundamental ideas that have
been reached in this TFG and they are: the importance and the great responsibility that the
Notary has established when assessing the capacity of the testator; and, on the other hand,
and the great possibility that is allowed to those people who suffer from a disability.
