España históricamente se ha venido configurando como un Estado
confesional, contemplándose dicho principio en todas las constituciones promulgadas
durante el siglo XIX, exceptuando la Constitución de 1869. Actualmente, bajo la
Constitución de 1978, la doctrina y la jurisprudencia han asentado las bases para entender la
laicidad del Estado cómo una garantía para la igual libertad de conciencia. Se puede llegar a
tal objetivo en un reducido periodo de tiempo, cuando la conjunción de los principios
constitucionales de igualdad y libertad, considerados como principios informadores del
ordenamiento español, aparezcan con el mismo nivel jurídico, en una fórmula que se
desprenda de la propia Constitución. En este caso podría hablarse de un principio de igualdad
en la libertad, equiparándolos y no siendo necesario que uno se sacrifique en virtud del otro.
Esto viene obstaculizándose a lo largo del propio constitucionalismo español, donde el
principio de confesionalidad y el contexto histórico lo impedía.
Spain has historically been configured as a confessional State, contemplating
this principle in all the constitutions promulgated during the 19th century, with the exception
of the 1869 Constitution. Currently, under the 1978 Constitution, doctrine and jurisprudence
have laid the foundations for understanding the secularism of the State as a guarantee for
equal freedom of conscience. Such an objective can be reached in a short period of time,
when the conjunction of the constitutional principles of equality and freedom, considered as
guiding principles of the Spanish legal system, appear with the same legal level, in a formula
that emerges from the Constitution itself. In this case, one could speak of a principle of
equality in freedom, equating them and not being necessary for one to sacrifice itself by virtue
of the other. This has been hindered throughout Spanish constitutionalism itself, where the
principle of confessionality and the historical context prevented it.
