Facultad de Derecho Barrio Higelmo, Álvaro 2023 Los profesionales médicos desempeñan un papel crucial en la social al garantizar el cumplimiento de los derechos fundamentales consagrados y reconocidos en la Constitución en el ámbito de la salud. Su labor no se limita a la mera atención clínica, ya que se les confía la responsabilidad de preservar la vida y la integridad, física y psíquica, promover el bienestar y garantizar la dignidad de las personas. En este contexto, es fundamental ahondar en un asunto referido a las posibles responsabilidades a las que los médicos pueden enfrentarse en su profesión, distinguiendo las siguientes: responsabilidad penal, responsabilidad civil, responsabilidad disciplinaria, responsabilidad deontológica y responsabilidad patrimonial de las Administraciones Públicas. En el presente Trabajo, de entre las responsabilidades enunciadas, centraremos nuestro estudio en la responsabilidad penal médica, cuyo interés y trascendencia cada vez es mayor por el auge de la autonomía del paciente y por las perspectivas que se vislumbran en cuanto a la aplicación de la Inteligencia Artificial. Medical professionals play a crucial role in society by ensuring compliance with the fundamental rights enshrined and recognized in the Constitution in the field of health. Their work is not limited to mere clinical care, as they are entrusted with the responsibility of preserving life and physical and psychological integrity, promoting well-being and guaranteeing the dignity of individuals. In this context, it is essential to delve into the possible liabilities that medical doctors may face in their profession, distinguishing the following: criminal liability, civil liability, disciplinary liability, deontological liability and the financial liability of the Public Administrations.
