Facultad de Derecho En el presente trabajo se hace una breve introducción del concepto de prostitución y de los datos relacionados con esta y con la trata. Se estudia el consentimiento discutiendo los argumentos que más se utilizan para justificar tanto moral como legalmente el ejercicio de esta práctica. Introduce un concepto: la naturaleza sexuada del ser humano, como premisa básica desde la que estudiar la prostitución. A través de distintas autoras se hace un repaso histórico y político de lo que he denominado el sustrato de la prostitución: todo el conglomerado en la que esta se erige y se sustenta. Los objetivos fundamentales que se persiguen son, precisamente señalar que no es casualidad que la prostitución sea un servicio de consumo masculino y llevado a cabo en su mayoría por mujeres, que tampoco lo es que esas mujeres normalmente se encuentren en situaciones cercanas a la exclusión social, desmontando así los argumentos neoliberalistas basados en las libertades individuales. Y dar cuenta de que tanto la libertad como el consentimiento son factores que, estudiados a fondo, no pueden entenderse como argumentos en los que apoyarse para justificar la prostitución. In this paper, a brief introduction is made to the concept of prostitution and the related data regarding it and trafficking. The concept of consent is examined, discussing the arguments commonly used to morally and legally justify engaging in this practice. It introduces a concept: the sexuated nature of human beings, as a basic premise from which to study prostitution. Through different authors, a historical and political overview is presented of what I have referred to as the substratum of prostitution, encompassing the entire conglomerate in which it arises and is sustained. The main objectives pursued are precisely to highlight that it is not a coincidence that prostitution is a service consumed primarily by men and carried out mostly by women, and that it is also not a coincidence that these women are often found in situations close to social exclusion, thereby dismantling neoliberalist arguments based on individual freedoms.
