De los delitos contra los derechos y deberes familiares

Este trabajo aborda en profundidad el Capítulo III del Libro XII del Código Penal, bajo el
Título: “De los delitos contra los Derechos y Deberes familiares”, correspondiente a los
artículos 223-233 CP. El bien jurídico protegido de este Capítulo en su conjunto, se basa
en preservar y resguardar la seguridad y el bienestar de los integrantes más vulnerables del
núcleo familiar, además de los derechos de custodia y patria potestad en situaciones de
discordia matrimonial.
Dentro de este Capítulo, podemos observar tres Secciones distintas: la primera de ellas se
centra en el “quebrantamiento de los deberes de custodia y a la inducción de menores al
abandono de domicilio”, formada por los artículos 223-225 CP. La segunda, referida a la
“sustracción de menores” incorporada al vigente CP por la LO 9/2002. Y, por último, la
tercera que hace referencia al “abandono de familia, menores o personas con discapacidad
necesitadas de especial protección”, que regula los arts. 226-233 CP.
This work deals in depth Chapter III of Book XII of Penal Code, under the Title: "Crimes
Against Family Rights and Duties", corresponding to articles 223-233 PC. The legal right
protected by this Chapter as a whole is based on preserving and protect the safety and
well-being of the most vulnerable members of the family nucleus, in addition to the rights
of custody and parental authority in situations of marital discord.
Within this Chapter, we can observe three different Sections: The first of them focuses in
the "breach of custody duties and the induction of minors to abandon domicile", formed
by articles 223-225 PC, the second, referring to "subtraction of minors" incorporated into
the active PC by Organic Law 9/2002, and, finally, the third that refers to "abandonment
of family, minors or people with disabilities in need of special protection", which regulates
articles 226-233 PC.
