Los INCOTERMS son términos comerciales cuyo propósito es facilitar la comprensión
de todo el proceso de las transacciones comerciales internacionales, especificando las
obligaciones, gastos, responsabilidades y riesgos involucrados en un contrato comercial.
Los INCOTERMS se clasifican como normas de Derecho Internacional Privado y
también son considerados un conjunto de reglas de Lex Mercatoria, reglas independientes
creadas ya sea por empresas o por la propia Cámara de Comercio Internacional - ICC,
con el objetivo de regular las transacciones que involucren comercio exterior, no estando
subordinadas a ninguna legislación nacional o supranacional. Este Trabajo de Fin de
Grado tiene como objetivo demostrar la aplicabilidad de los INCOTERMS y además de
presentar el Arbitraje Internacional - un mecanismo ampliamente utilizado en el comercio
internacional para la resolución de conflictos contractuales, en una alternativa camino a
la no judicialización. Para ello, se abordará el caso ARAMCO con un gran ejemplo del
uso del arbitraje internacional en el comercio internacional. Concluimos que los
desarrollos tecnológicos que aumentan las compras y ventas en el comercio internacional
impulsado por la globalización generan una necesidad más recurrente de revisar los
términos comerciales internacionales en un tiempo mucho menor a 10 años, con el
objetivo de mantenerse al día con los avances tecnológicos.
INCOTERMS are commercial terms whose purpose is to facilitate the understanding of
the entire process of international commercial transactions, specifying the obligations,
expenses, responsibilities and risks involved in a commercial contract. INCOTERMS are
classified as norms of Private International Law and are also considered a set of Lex
Mercatoria rules, independent rules created either by companies or by the International
Chamber of Commerce - ICC itself, with the objective of regulating transactions
involving trade. external, not being subordinated to any national or supranational
legislation. This Final Degree Project aims to demonstrate the applicability of
INCOTERMS and also present International Arbitration - a mechanism widely used in
international trade for the resolution of contractual conflicts, in an alternative to nonjudicialization.
To do this, the ARAMCO case will be addressed with a great example of
the use of international arbitration in international trade. We conclude that technological
developments that increase buying and selling in international trade driven by
globalization generate a more recurrent need to review international commercial terms in
a time much shorter than 10 years, with the aim of keeping up with technological
advances.
