Hasta que estos puedan prestar consentimiento serán sus representantes legales los encargados de otorgarlo. Para ello, analizaremos la capacidad del menor para poder prestar su consentimiento centrándonos en sus representantes legales, que también tienen responsabilidades pudiendo consentir el uso de la imagen del menor. Lo más importante es que en todo momento se tiene que salvaguardar su integridad. Al utilizarse la imagen del menor pueden producirse intromisiones ilegitimas lesionando sus derechos sin ser ellos conscientes de lo que puede conllevar. Cuando se utiliza la imagen del menor indebidamente por parte de sus representantes interviene el Ministerio Fiscal. En la actualidad, hay muchos ámbitos en los que el derecho a la intimidad de los menores de edad se ve perjudicado sin ser conscientes de ello. Tiene gran importancia el uso de las imágenes del menor por la prensa, los menores famosos, el sector de la publicidad, las redes sociales, los influencers… Hay que tener mucho cuidado cuándo se publica una imagen en Internet o en cualquier medio, pero cuándo la imagen es de un niño, hay que ser todavía más cuidadoso y responsable.
