El presente trabajo consiste en un estudio jurídico-normativo del discurso del odio,
orientado a comprender mejor su contenido y sus límites. Para ello se analizarán los
componentes principales de su concepto, intentando delimitar el conflicto entre la libertad
de expresión y el discurso del odio, y los estándares de protección existentes a nivel
nacional e internacional. Lugar especial ocupará en el presente estudio, por particular
gravedad respecto de la protección de la dignidad humana, la proliferación actual del
mismo y la repercusión social que provoca, el discurso del odio basado en motivos étnicos
y raciales.
The present work consists of a legal-normative study of hate speech, aimed at better understanding its
content and its limits. To do this, the main components of its concept will be analyzed, trying to delimit the
conflict between freedom of expression and hate speech, and the existing protection standards at the national and international level. Hate speech based on ethnic and racial motives will occupy a special place in this study, due to particular gravity with respect to the protection of human dignity, its current proliferation and the social repercussion it causes.
