Facultad de Derecho Situaciones y peculiaridades qué pueden llegar a suscitar los casos de Crisis Matrimoniales Internacionales en el marco de la Unión Europea, y cómo se solucionan en base al Reglamento (UE) 2201/2003 (o Reglamento “Bruselas II bis”) y a la normativa interna de los Estados miembros si ésta fuera aplicable: ambas “soluciones” versan sobre la atribución de competencia judicial internacional, el primero otorgándosela a los órdenes jurisdiccionales de un Estado miembro, y el segundo en caso de que no se aplicara el Reglamento, atribuye tal competencia a los Tribunales internos que tengan conexión con el asunto. En cuanto a la ley aplicable se tiene en cuenta el Reglamento (UE) 1259/2010 (o Reglamento “Roma III”) por el que se establece una cooperación reforzada entre los Estados miembros anexos al mismo, que abarca la ley aplicable respecto al divorcio y la separación judicial, teniendo en cuenta la concreción de esta y los supuestos que no son de aplicación. Así mismo, se analiza la ley aplicable en cada uno de los supuestos no regulados en el Reglamento, como es la nulidad matrimonial. This paper attempts to explain which are the situations and peculiarities that could arise in cases of International Matrimonial Matters within the framework of the European Union, and how are they solved taking into account the Regulation (EC) 2201/2003 (or Regulation “Brussels II bis”) and the national regulation of the Member States if applicable: both “solutions” deal with the attribution of international judicial jurisdiction: the first one granting it to the legal systems of a Member State, and the second one attributes such competence to the internal Courts that have conection with the matter, when the Regulation is not applied.
