Kennedy, durante el célebre discurso que pronunció ante el Congreso norteamericano el 15 de Marzo de 1962, dejó claro que “consumidores, por definición, somos todos”.1 Ahora bien, frente a los consumidores se encuentran los empresarios, con quienes, inevitablemente, se deberá concurrir en el mercado. En ocasiones, estos empresarios se aprovechan de su situación de superioridad para adoptar conductas abusivas que les permitan operar únicamente siguiendo sus propios intereses. Ante este tipo de situaciones, surge la necesidad de que los consumidores puedan hacer valer sus derechos y ejercitar las pertinentes acciones, bien a través de los tribunales, bien extrajudicialmente. No obstante, en este momento aparece una pregunta inevitable: ¿realmente la legislación vigente protege a los usuarios y facilita su acceso a la justicia? A lo largo de este Trabajo se apreciará que la respuesta es, a menudo, negativa, quedando, en consecuencia, mucho por avanzar en esta materia. En una economía globalizada, donde los consumidores juegan un papel absolutamente trascendental, la protección que se les brinda debería estar a la altura de las expectativas. The President of the United States between 1961 and 1963, John F. Kennedy, during his famous speech to the US Congress on March 15, 1962, made it clear that "consumers, by definition, include us all". However, on the other side we may find the entrepreneurs, with whom, inevitably, we coincide in the market. Sometimes, these businesspeople take advantage of their superiority to adopt abusive conducts that allow them to operate only in their own interests. Faced with this kind of situations, consumers need to be able to assert their rights and exercise the pertinent actions either through the courts or out of the courts. Nevertheless, at this point an inevitable question arises: does current legislation really protect users and facilitate their access to justice? It will be shown that the answer is often negative and, consequently, there is still a long way to go in this area. In a globalized economy, where consumers play an absolutely transcendental role, the protection afforded to them should live up to the expectations.
