La incapacidad permanente en España está regulada principalmente por el Texto Refundido de la Ley General de la Seguridad Social (TRLGSS), aprobado por el Real Decreto Legislativo 8/2015, de 30 de octubre. Este régimen legal define la incapacidad permanente como la situación del trabajador que, después de haber estado sometido al tratamiento prescrito, presenta reducciones anatómicas o funcionales graves, susceptibles de determinación objetiva y previsiblemente definitivas, que disminuyen o anulan su capacidad laboral.
Permanent disability in Spain is regulated mainly by the Consolidated Text of the
General Social Security Law (TRLGSS), approved by Royal Legislative Decree 8/2015, of October 30.
This legal regime defines permanent disability as the situation of a worker who, after having been
subjected to the prescribed treatment, presents serious anatomical or functional reductions,
susceptible to objective determination and
foreseeably definitive, which reduce or nullify his or her work capacity.
