Los contratos de concesión son una modalidad de contratos administrativos entre el
poder adjudicador o entidad adjudicadora y una empresa privada, en virtud del cual el órgano
de contratación confiere el derecho de explotación de obras o servicios al concesionario
durante un tiempo determinado y debe implicar la transferencia del riesgo operacional.
En este trabajo se plantea un análisis exhaustivo de todo el procedimiento de
contratación desde los actos preparatorios, hasta la extinción del contrato, así como de la
delimitación de dichos contratos y sus características más relevantes y diferenciadoras con
respecto a otros contratos del sector público.
Concession contracts are a kind of administrative contracts amongst the contracting
authority or the contracting entity and a private company, by virtue of what the contracting
entity grants the right to exploit works or services to the concessionaire during a certain
period of time and it must involve the transfer of the operating risk.
This paper provides an exhaustive analysis of the entire contracting procedure, from the
preparatory acts to the termination of the contract, as well as the delimitation of these
contracts and their most relevant differentiating features regarding other contracts from the
public.
