El derecho a una identidad consiste en el reconocimiento jurídico y social
de una persona, y engloba, entre otros, el derecho a poseer un nombre, unos apellidos y
una nacionalidad, lo cual es decisivo en la vida de un niño tanto para su reconocimiento
como para su posterior protección legal.
Además, el derecho al registro de nacimiento, la adquisición de una nacionalidad y de una
filiación son esenciales para que cualquier niño pueda establecer su existencia e identidad.
Esto es importante para su desarrollo psicológico y social, además de ser un derecho
“llave” para el beneficio de otros derechos fundamentales.
Asimismo, la especial protección que se da se debe a que este derecho es crucial para el
desarrollo de la personalidad, proporcionándoles una base sólida en el momento de
formarse.
Los niños a los que no se les es reconocida una identidad son invisibles a los ojos de la
sociedad debido a que no figuran en ningún documento oficial y es por esto por lo que será
imposible que sus derechos sean protegidos.
The right to an identity is the legal and social recognition of a person,
including the right to a first name, surname and nationality, which is crucial in a child's life
for both recognition and subsequent legal protection.

essential for any child to establish his or her existence and identity.

Children who are not recognised as having an identity are invisible in the eyes of society
