En el presente trabajo trataremos el tipo básico del delito de tráfico de drogas, analizando en
primer lugar el debate político criminal que ha ido suscitando a lo largo de los años este delito
en cuanto a que política debe seguirse para reprimir este problema, bien un modelo
prohibicionista (seguido en España), un modelo de despenalización controlada, o bien un
modelo intermedio entre ambos, basado en la reducción de daños. Delimitaremos el bien
jurídico protegido, así como su naturaleza. Veremos que se entiende por salud pública y las
diferentes interpretaciones que ha ido realizando el Tribunal Supremo. Trataremos los
elementos del tipo básico, centrando el objeto material: drogas tóxicas, sustancias
psicotrópicas y estupefaciente; y las conductas típicas: cultivo, elaboración, tráfico, posesión
con aquellos fines y promoción, favorecimiento y facilitación. A continuación, veremos que
supuestos son considerados atípicos. Por último, examinaremos en que casos la
jurisprudencia entiende que existe tentativa y participación y que tipo de concursos caben
con este delito.
In this work, we will deal with the basic type of the crime of drug trafficking, analyzing first
of all the criminal policy debate that this crime has raised over the years as to what policy
should be followed to repress this problem, whether a prohibitionist model (followed in
Spain), a model of controlled decriminalization, or an intermediate model between the two,
based on harm reduction. We will define the protected legal asset and its nature. We will see
what is understood by public health and the different interpretations made by the Supreme
Court. Then we will deal with the elements of the basic type, focusing on the material object:
toxic drugs, psychotropic substances, and narcotic drugs; and the typical conducts:
cultivation, elaboration, trafficking, possession for those purposes and promotion, favoring
and facilitation. Next, we will see which cases are considered atypical. Finally, we will examine
in which cases the jurisprudence understands that there is attempt and participation and what
type of concurrences fit in this crime.
