Facultad de Derecho Maternidad subrogada Gestante Técnicas de reproducción 5605.02 Derecho Civil La maternidad subrogada es un fenómeno social, también conocido como “vientre de alquiler”, a través del cual la mujer subrogada se compromete, mediante un contrato, a ser fecundada (artificialmente) y culminar su proceso de gestación. Esta técnica de reproducción asistida permite a millones de parejas infértiles, solteras o con dificultades para procrear, tener hijos y, además provoca un debate complejo en el que se distinguen dos posturas: por un lado, los que consideran la maternidad subrogada como un avance que ofrece una alternativa nueva a aquellas familias o personas que se encuentran ante imposibilidades para la concepción natural; y, por otro lado, los que conciben dicha práctica como una explotación hacia la mujer. En el presente trabajo abordaremos el concepto de la maternidad subrogada, así como, diversas figuras afines; la legalidad de esta desde la perspectiva de diferentes países, haciendo mayor hincapié en la legalidad y jurisprudencia española; y analizaremos distintos casos actuales. Surrogate motherhood is a social phenomenon, also known as surrogacy, whereby which the surrogate woman agrees to be fertilized, through a contract, and complete the pregnancy process. This assisted reproduction technique allows millions of infertile couples, singles or with difficulties to procreate to have children, and it sparks a debate in which two positions are distinguished: on the one hand, those who consider the surrogate motherhood as an advanced that offers a new alternative to those families with difficulties for natural conception; on the other hand, those who conceive it as exploitation towards women. In this work, we will address the concept of surrogate motherhood as well as various related figures; the legality of it from the perspective of different countries, with more emphasis on Spanish legality and jurisprudence; and we will analyze different current cases.
