Los "nuevos derechos" en la jurisprudencia del Tribunal Constitucional (matrimonio homosexual, aborto y eutanasia)

El presente trabajo de fin de grado tiene como objeto el análisis del reconocimiento por el Tribunal Constitucional de la creación legislativa de nuevos derechos con fundamento jurídico-constitucional. Para ello, se toman como referencia las leyes sobre el matrimonio de personas del mismo sexo, libre interrupción del embarazo y eutanasia, así como las sentencias de nuestro más alto tribunal recaídas sobre las mismas. En estas resoluciones del Tribunal Constitucional se descubre una doctrina de fondo común a cerca de la extensión de la protección iusfundamental a nuevos supuestos vinculados con la interpretación evolutiva de la Constitución.
The aim of this thesis is to analyse the recognition by the Constitutional Court of the legislative creation of new rights with a legal-constitutional basis. To this end, the laws on same-sex marriage, free termination of pregnancy and euthanasia are taken as a reference, as well as the rulings of our highest court on them. These rulings of the Constitutional Court reveal a common basic doctrine regarding the extension of the protection of fundamental rights to new cases linked to the evolving interpretation of the Constitution.
