Facultad de Derecho 2025-06-17T12:07:07Z 2025-06-17T12:07:07Z 2024 https://uvadoc.uva.es/handle/10324/76015 En el presente trabajo analizaremos la institución de la desheredación y las diferentes causas por las que se puede privar de la legítima a un heredero forzoso haciendo hincapié en el art. 853.2 del CC, que se ha interpretado de forma más flexible para adaptarse a las nuevas situaciones sociales y familiares que van surgiendo. A su vez se compara la desheredación con otras figuras como la indignidad y la preterición analizando sus diferencias y similitudes. A continuación, se analizan las diferentes sentencias del Tribunal Supremo que han creado jurisprudencia y sentada doctrina, incluyendo el maltrato psicológico, que abarca el abandono de las personas mayores, el desapego emocional y la falta de afecto y cuidado, dentro del maltrato de obra. Esta situación agravada durante la pandemia también será objeto de estudio donde veremos datos estadísticos y casos concretos de demandas de desheredación porque muchos de nuestros mayores han sido abandonados por sus familiares con derechos legitimarios y es que, a pesar de que del Derecho de Sucesiones tiene un marcado carácter proteccionista de la legítima, a lo largo de este trabajo se pone de manifiesto que es necesaria una reforma del Derecho de Sucesiones y más concretamente de la desheredación y sus causas. In this paper we will analyse the institution of disinheritance and the different causes for which a forced heir can be deprived of his or her legitimate share, with emphasis on art. 853.2 of the CC, which has been interpreted in a more flexible way in order to adapt to the new social and family situations that are arising. At the same time, disinheritance is compared with other concepts such as unworthiness and preterition, analysing their differences and similarities. The following is an analysis of the different rulings of the Supreme Court that have created jurisprudence and established doctrine, including psychological abuse, which includes abandonment of the elderly, emotional detachment and lack of affection and care, within the scope of mistreatment by deeds. This situation, aggravated during the pandemic, will also be the subject of a study in which we will see statistical data and specific cases of claims for disinheritance because many of our elders have been abandoned by their relatives with legitimate rights, and despite the fact that Inheritance Law has a markedly protectionist character of the legitimate rights, throughout this work it becomes clear that a reform of Inheritance Law and more specifically of disinheritance and its causes is necessary.
