En este trabajo se analiza en profundidad el ISD en el sistema tributario español, abordando
sus antecedentes, concepto, naturaleza, y la legislación aplicable, como la Ley 29/1987 y el
RD 1629/1991. Se examina la situación actual del impuesto, su aplicación, la transmisión de
la empresa familiar, y las opiniones doctrinales, destacando tanto defensores como
detractores del ISD, así como propuestas de reforma. Además, se explora la regulación del
impuesto en diferentes Comunidades Autónomas, incluyendo los regímenes forales, y se
discuten los desafíos futuros, problemas constitucionales, y la situación comparada del ISD
a nivel internacional.
This paper provides an in-depth analysis of the Inheritance and Gift Tax (ISD) within the
Spanish tax system, covering its background, concept, nature, and applicable legislation, such
as Law 29/1987 and RD 1629/1991. The current situation of the tax is examined, including
its application, the transfer of family businesses, and doctrinal opinions, highlighting both
supporters and critics of the ISD, as well as reform proposals. Furthermore, the regulation
of the tax across different Autonomous Communities is explored, including the foral
regimes, and future challenges, constitutional issues, and the comparative international
situation of the ISD are discussed.
