El presente trabajo tiene por objeto el estudio de la regulación del Impuesto sobre Bienes
Inmuebles (en adelante IBI) en España. Para dar comienzo con el mismo, y como base sobre
la que abordar el tema, se llevará a cabo un análisis de la normativa que regula el IBI en el
Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido
de la Ley Reguladora de las Haciendas Locales. Posteriormente, se hará referencia a varias
cuestiones conflictivas que surgen acerca del impuesto, analizando aspectos como las
diferencias entre el valor de mercado de los inmuebles y el valor catastral, las discrepancias
que surgen a la hora de determinar el sujeto pasivo del IBI cuando existen diferencias entre
los datos obrantes en el Registro de la Propiedad o los del Catastro Inmobiliario, el IBI de
las confesiones religiosas o el tratamiento de la vivienda desocupada, entre otras cuestiones
analizadas. Finalmente, se hará un estudio de la evolución del IBI en los últimos años con
especial referencia al municipio de Palencia.
The aim of this essay is studying the regulation of Local Property Tax (Impuesto sobre Bienes
Inmuebles, from here forth IBI) in Spain. As a basis for addressing the topic, it will begin
with an analysis of the regulations governing the Property Tax (IBI), that is, the Royal
legislative Decree 2/2004, 5th march, which approves the Revised Text of the Regulatory
Law of Local Revenue Agencies. Subsequently, several controversial issues arising from the
tax will be dealt with and analysed, such as the differences between the market value of
properties and the cadastral value, the discrepancies which arise when determining the
taxpayer for the Property Tax (IBI) in those cases there are differences between the data held
in the Property Registry and the Real Estate Cadastre, also IBI on religious confessions or
the dealings with unoccupied housing, among others issues. Finally, a study of the evolution
on IBI in recent years, with special reference to the municipality of Palencia will be made.
