El presente trabajo tiene como finalidad abordar y analizar la viabilidad de
implementar la justicia restaurativa en los delitos de terrorismo. Para ello, se ha
realizado un análisis desde los conceptos de terrorismo y víctima del terrorismo,
así como de un análisis sobre la estructura legal prevista en las leyes actuales y por
último la opinión de las víctimas sobre la posibilidad de realizar encuentros
restaurativos.
Gran parte del trabajo se centra en analizar el actual marco legal de la
justicia restaurativa, en particular, la Ley 4/2015, de 27 de abril, del Estatuto de la
Víctima del delito, y la más reciente LO 1/2025, de 2 de enero, de medidas en
materia de eficiencia del Servicio Público de Justicia.
De una forma más individual se analiza la visión de las víctimas, las figuras
principales del proceso restaurativo, sobre su voluntad o no de realizar los
encuentros restaurativos, así como de su opinión sobre la actualidad en España y
sus esperanzas futuras de cambio para obtener mayor reconocimiento y una mejor
subsanación de los daños percibidos.
Para finalizar, se realiza un análisis comparado entre los países de Irlanda
del Norte y España respecto a su actuación en materia restaurativa tras sufrir
enormes daños por atentados terroristas cometidos por las bandas terroristas del
IRA y ETA.
The purpose of this paper is to address and analyze the feasibility of
implementing Restorative Justice in cases of terrorism-related crimes. To this end,
an analysis has been conducted starting from the concepts of terrorism and
terrorism victims, followed by a review of the legal framework established by actual
laws, and finally, an exploration of victims' opinions on the possibility of holding
restorative encounters.
A significant portion of the paper focuses on analyzing the current legal
framework of Restorative Justice, reviewing several laws such as Law 4/2015 of April
27, on the Statute of the Crime Victim, and the more recent Organic Law 1/2025 of
January 2, on measures to improve the efficiency of the Public Justice Service.
From a more individual perspective, the paper examines the views of
victims—the central figures in the restorative process—regarding their willingness
(or unwillingness) to participate in restorative encounters, as well as their opinions
on the current situation in Spain and their future hopes for change, greater
recognition, and better reparation for the harm they have suffered.
Finally, a comparative analysis is carried out between Northern Ireland and
Spain regarding their restorative justice responses after experiencing severe harm
from terrorist attacks perpetrated by the IRA and ETA, respectively.
