Las devoluciones en caliente. Análisis constitucional

El objetivo del presente trabajo es estudiar el fenómeno de la inmigración en los
últimos años, con especial atención a las denominadas “devoluciones en
caliente” o devoluciones sumarias. Estas prácticas, que consisten en la expulsión
inmediata de aquellos inmigrantes que intenta pasar la frontera, han generado
un debate, tanto social como político.
Así, estudiaremos el marco normativo de su regulación, su compatibilidad con
los derechos fundamentales de la Constitucional española y con los Tratados
internacionales de los que España es parte. Además, abordaremos las
implicaciones sociales y las corrientes políticas actualmente existentes en
nuestra sociedad respecto al tema. Por último, se hará un estudio de la
jurisprudencia que es de interés.
The aim of the present paper is to study the phenomenon of immigration in recent
years, with special attention to the so-called "pushbacks" or summary returns.
These practices, which consist of the immediate expulsion of those immigrants
who attempt to cross the border, have generated a debate, both social and
political.
Thus, we will study the regulatory framework governing them, their compatibility
with the fundamental rights of the Spanish Constitution and with the international
treaties to which Spain is a party. In addition, we will address the social
implications and the current political trends in our society regarding this issue.
Finally, a study of the relevant case law will be carried out.
