El presente trabajo analiza la protección del menor en los supuestos de ruptura
conflictiva entre sus progenitores, prestando especial atención al principio del interés
superior del menor como eje rector del procedimiento. Se examina su regulación y
aplicación práctica en cuestiones fundamentales que surgen tras la ruptura, tales como la
guarda y custodia, el régimen de visitas, la patria potestad o la obligación de alimentos.
El trabajo también pone de relieve los derechos específicos del menor en estos
contextos, como el derecho a ser oído y a mantener vínculos familiares. Se defiende que
la protección del menor en estas situaciones constituye un deber esencial e irrenunciable
del ordenamiento jurídico, orientado siempre a garantizar su bienestar integral.
Además, se abordan las distintas formas de custodia: exclusiva, compartida, partida o
atribuida a terceros y se analiza el impacto que estas decisiones pueden tener en el
desarrollo emocional y social del menor. También se estudian los conflictos más
frecuentes derivados de las rupturas matrimoniales o de parejas de hecho, y las medidas
que el sistema jurídico ofrece para minimizar sus efectos negativos. Todo ello se apoya
en el marco normativo vigente, en la jurisprudencia relevante y en aportaciones
doctrinales que enriquecen el debate y permiten una visión más completa y crítica del
tema.
The present paper analyzes the protection of minors in situations of high-conflict
parental separation, with particular emphasis on the principle of the best interests of the
child as the cornerstone of legal proceedings. It explores the normative framework and
its practical application to fundamental issues arising from such ruptures, including
custody arrangements, visitation regimes, the exercise of parental responsibility, and the
duty to provide child support. The paper further underscores the specific rights of the
child in these contexts, notably the right to be heard and to maintain meaningful familial
relationships. It advocates that safeguarding the rights and well-being of the minor in
such situations constitutes an essential and non-derogable obligation of the legal system,
aimed at ensuring the child’s holistic development.
In addition, the study examines the various forms of custody: sole, joint, split, or
granted to third parties and assesses the potential impact of these arrangements on the
child’s emotional and social development. It also addresses the most recurrent conflicts
arising from the dissolution of marriages or de facto partnerships and analyzes the legal
mechanisms available to mitigate their adverse consequences. All analyses are grounded
in the applicable legal framework, relevant jurisprudence, and doctrinal contributions,
which together enrich the discussion and offer a more nuanced and critical perspective
on the subject matter.
