ANÁLISIS DE LA LEY 15/2022, DE 12 DE JULIO, INTEGRAL PARA LA IGUALDAD DE TRATO Y LA NO DISCRIMINACIÓN

El presente trabajo analiza la Ley 15/2022, de 12 de julio, Integral para la Igualdad de Trato
y la No Discriminación, examinando su estructura normativa, contenido y principales
novedades. Se estudian las nuevas causas de discriminación reconocidas por la ley, así como
las tipologías introducidas, con especial atención al ámbito laboral. Además, se aborda la
integración de los modelos de igualdad de trato y de oportunidades, la creación de la
Autoridad Independiente y el régimen sancionador, evaluando sus fortalezas y limitaciones.
Finalmente, se realiza un análisis crítico de la norma, recogiendo las principales observaciones
formuladas por la doctrina sobre sus ambigüedades conceptuales, técnica legislativa y
dificultades de aplicación práctica.
This paper analyzes Law 15/2022, of July 12, Comprehensive Equality of Treatment and
Non-Discrimination, examining its legal structure, content, and main innovations. It explores
the new grounds of discrimination recognized by the law, as well as the types of
discrimination introduced, with a particular focus on the labor sphere. Additionally, it
addresses the integration of the models of equal treatment and equal opportunities, the
creation of the Independent Authority, and the sanctioning regime, evaluating their strengths
and limitations. Finally, the work offers a critical analysis of the law, highlighting the main
observations made by legal scholars regarding its conceptual ambiguities, legislative
technique, and challenges in practical implementation.
