A lo largo de este trabajo se analizará la viabilidad de una acción de responsabilidad civil
derivada de una negligencia médica ocurrida en el contexto de la asistencia prestada a la
actora durante el parto por una obstetra en un hospital privado perteneciente a la red de la
aseguradora que tiene contratada la citada.
En el supuesto de hecho se plantea la existencia de un daño y unas secuelas gravísimas y de
carácter irreversible en el menor como consecuencia de la omisión injustificada de una
cesárea urgente tras constar acreditada la existencia de evidentes signos de sufrimiento fetal.
Teniendo en cuenta el precitado escenario se analizarán los elementos clave de la
responsabilidad civil médica en el ámbito privado diferenciando entre la responsabilidad
exigible al médico interviniente (responsabilidad extracontractual) y la exigible a la
aseguradora (responsabilidad contractual) pero centrando el análisis en la responsabilidad de
la obstetra.
This paper will analyse the viability of a civil liability action arising from medical negligence
occurring in the context of the assistance provided to the plaintiff during childbirth by an
obstetrician in a private hospital belonging to the network of the insurance company
contracted by the plaintiff.
In the case in question, the existence of damage and very serious and irreversible
consequences for the child as a result of the unjustified omission of an emergency caesarean
section after the existence of obvious signs of foetal distress was established.
Taking into account the aforementioned scenario, the key elements of medical civil liability
in the private sphere will be analysed, differentiating between the liability demanded of the
intervening doctor (non-contractual liability) and that demanded of the insurer (contractual
liability), but focusing the analysis on the liability of the obstetrician.
