In complex societies the condition of “the other” is defined by the religious, the ethnic, the political, the cultural, etc., in this paper the “Indian” will be alluded to a figure that unites practically all of these perspectives both from the vision of Francisco de Vitoria as from a current perspective in order to determine the status of their rights.
