El procedimiento de Habeas Corpus

El habeas corpus una institución jurídica esencial desde sus orígenes hasta la
etapa actual, siendo una herramienta fundamental para garantizar y tutelar la protección
de la libertad ambulatoria de las personas frente a aquellas detenciones que pueden ser
ilegales.
Nuestro ordenamiento establece la obligación de presentar ante el juez a toda
persona detenida que solicite dicho procedimiento. El habeas corpus tiene que ser
resuelto en un plazo breve de tiempo y el auto dictado por el juez puede establecer la
libertad inmediata del detenido sino existieran motivos suficientes para privar a esa
persona de libertad, o bien puede autorizar que siga privado de libertad, si bien con
pleno respeto de sus derechos y garantías.
Habeas Corpus is an essential legal institution from its origins to the current
stage, being a fundamental tool to guarantee and protect the protection of the liberty of
people against those arrests that may be unfair.
There is an obligation to present to the judge any detained person who requests
said procedure. The habeas corpus must be resolved within a short period of time and
the order issued by the judge can establish the immediate release of the detainee if there
are not sufficient reasons to deprive that person of liberty.
