A new legislative regime is absolutely basic to the development for the EU Internal market within the framework of a fiercely competitive global economy for businesses. It is a system that is truly essential but which is handicapped by the lack of unanimity form all member States for linguistic reasons. The lack of unanimity is the main reason why the new legislation is particularly complex in addition to being incomplete, especially with respect to the new European unitary patent system which revolves around a Unified Patent Court whose fit into the EU s uniform jurisdiction rule looks to be problematic.
