A1 Iglesias Sevillano, Héctor A2 Ediciones Universidad de Valladolid K1 Justicia Países de la Unión Europea K1 Tribunal de Justicia de las Comunidades Europeas AB The present work explores the implications of the dialogue between the member State’s Courts of Justice and the ECJ for the construction of a European concept of Justice. From this starting point, we argue that this dialogue is essential to seek an innovative approach to EU law, in which Justice would mean, not the mainstream position of the member States themselves, but a concept elaborated by the european institutions, and essenti ally the ECJ. This development would happen to be particularly important in the area of human rights. In this matter, we back the position of the minority of Judges in the Spanish Constitutional Court Melloni case, and argue for a direct application of hum an rights as recognized in EU law by the member State’s Courts, even when they do not have an express procedural leave to do so in their own applicable law. This proposal would aim at finding a way to make this “european concept of Justice” applicable with in the member States.
