But the particularism, pragmatism and informalism common to the ECHR practice, contrasting with the decisions of national courts, provoke an initial sense of discomfort and even disillusionment in the minds most accustomed to legal science based on principles and norms. Here we are now obliged to reason from the analogies and differences of the particular cases decided by the ECHR. Are we in full transition to a model of case-law? The question does not have a single answer, because it will depend very much on the legal methodology assumptions admitted by each one of us as valid reasons to decide the particular cases. But it is true that a logical-deductive and concetual legal thought, enshrined in the domestic legal instruments of law, is definitely set aside. The case-law of the ECHR obliges legal theorists and practitioners to transcend the comfort zone of national legal systems and fosters the development of a universalizable legal science. At the same time, comparative law ceases to be pure erudition to become a necessary instrument for all legal science.
