AB The purpose of this work is the analyse of the legal issues related to the practice of the search and seizure diligence to obtain evidence of the crime committed, in the scope of the criminal investigation.  Paying  special attention to the guarantee of the fundamental rights that correspond to  the person under investigation and the way in which new technologies have affected the criminal investigation. we have examined in this work, with this objective, the spanish legal reform introduced in our legal system in 2015 and the case law.
