AB Oblivion is part of the human personality. However, often, those responsible for processing citizens' personal data, with the essential support of emerging disruptive technologies, want the information to remain accessible indefinitely in order to achieve their objectives. As a counterbalance, the Community legal system, in the context of the right to privacy, has come to configure a right to digital oblivion, and even, jurisprudentially, it is intended to build a broader constitutional right of a new generation called the right to the digital environment. In any case, the right to data protection is configured as a fundamental right in permanent construction in a society such as ours, in which new technological developments are emerging and in which data are, in short, the genuine fuel of the digital economy. The right to digital oblivion is specifically recognised in the General Data Protection Regulation and it arises as a consequence of a transcendental jurisprudential development in the EU. This right, which has North American origin, at least in its conception, currently presents numerous gaps in its practical exercise and, as we will see throughout this extensive work, it is not infrequently presented as a diminished and completely ineffective right for the purposes pursued by those affected in the legitimate exercise of their rights.This doctoral thesis aims, in short, to analyse the configuration and form of protection of the right to digital oblivion on the European continent, and to propose possible actions aimed at its effective recognition and to minimise the negative impact of the tendency towards the perpetuity of our personal data on the Internet.
