AB The thesis aims to explore the legitimacy of plea bargaining within the criminal law of the Latin-Germanic legal system. Based on the study of the utilitarian philosophical framework, it examines the possibility of incorporating plea bargaining into criminal law dogmatics. Ultimately, it proposes a synthetic formula to balance the values of a rights-based criminal justice system with the exceptional nature of a combat-oriented criminal law.
