El contrato de transporte terrestre de mercancías en la Unión Europea

Abstract

El transporte es una actividad esencial para el desarrollo del comercio y por lo tanto de la economía. Debido a su importancia en la economía ha sido necesaria la intervención por parte del legislador en su regulación. Con la creación de la Unión Europea se han producido una serie de cambios a nivel político, social y económico que han afectado significativamente al transporte. Por ello en este trabajo vamos a estudiar la regulación de la actividad de transporte terrestre de mercancías, el contrato de transporte (instrumento privado por excelencia para su regulación) y la intervención de la Unión Europea en su regulación. Posteriormente vamos a ver cómo han evolucionado diferentes variables económicas asociadas al transporte en las tres últimas décadas, qué conclusiones podemos extraer y qué objetivos aún están pendientes de cumplir para alcanzar un desarrollo sostenible.

The transport activity is essential for the development of trade and therefore of the economy. Because of its importance in the economy the intervention of the legislator in its regulation has been necessary. With the creation of the European Union there were political, social and economic changes that have significantly affected the transport. That’s why in this paper we will study the regulation of the activity of trade of goods, the private instrument used for his regulation: the contract of transport and the intervention of the European Union in its regulation. After that we will see how the different economic variables associated with transport have evolved during the last three decades and get conclusions and remaining objectives to chase sustainable development.
