El fenómeno del consumo colaborativo en el sector del alojamiento turístico ha experimentado un auge imparable en los últimos años, ofreciendo una alternativa a los sistemas habituales de hospedaje. Ahora bien, la irrupción de este nuevo modelo de negocio –o más bien, su increíble expansión- ha desatado los recelos de los operadores tradicionales y ha motivado una inicial toma de posición restrictiva por parte, fundamentalmente, de las autoridades municipales y las CC.AA. , que han respondido con un nuevo, estricto y heterogéneo marco regulatorio. El objetivo del presente trabajo es el análisis de algunas de las disposiciones más controvertidas de estas normas sobre viviendas de uso turístico, valorando su adecuación para la resolución de los problemas identificados así como la posibilidad de su tratamiento mediante otras medidas alternativas más permisivas.
The phenomenon of collaborative consumption in the tourist accommodation sector has experienced an unstoppable boom in recent years, offering an alternative to the usual lodging systems.However, the emergence of this new business model -or rather, its incredible expansion- has unleashed the misgivings of traditional operators and has led to an initial takeover of a restrictive position, mainly by the municipal authorities and the CC. AA. , which have responded with a new, strict and heterogeneous regulatory framework. The objective of this paper is the analysis of some of the most controversial provisions of these regulations, assessing their suitability for the resolution of the identified problems as well as the possibility of their treatment through other more permissive alternative measures.
