Reforma del Proceso Penal: hacia un fiscal investigador

Abstract

El presente Trabajo de Fin de Grado tiene como objetivo el estudio de una hipotética reforma del proceso penal español que supondría abandonar en nuestro país el tradicional modelo del juez instructor para acoger un sistema en el que el encargado de la investigación sea el Ministerio Fiscal. Para ello, se toman como base los dos anteproyectos de reforma del proceso penal más recientes en España, que trataban de instaurar la figura del fiscal investigador, apoyado por el juez de garantías. Con el trabajo se pretende analizar cuáles son las ventajas e inconvenientes de este nuevo sistema, ya presente en muchos países de nuestro entorno, y plantear qué requisitos previos serían necesarios para poder poner en marcha una reforma tan relevante.

The aim of this project is to study a hypothetical reform of the Spanish criminal proceeding that would entail abandoning the traditional model based on the investigating judge to host a system in which the investigation is carried out by the Public Prosecutor. For this, the two most recent preliminary drafts of reform of the criminal proceeding in Spain are taken as a basis, which tried to establish the figure of the investigating prosecutor, supported by the judge of guarantees. The purpose is to analyze what the advantages and disadvantages of this new system are, already present in many countries around us, and to establish what prerequisites would be necessary to implement such a relevant reform.
