El aforamiento de los parlamentarios

Abstract

En el presente trabajo realizaremos un análisis exhaustivo de la prerrogativa parlamentaria del aforamiento del artículo 71.3 CE. Comenzaremos introduciendo este trabajo a través de la diferenciación de las tres prerrogativas que componen el estatus parlamentario, antes de proceder a situar en su contexto esta prerrogativa, dentro del Ordenamiento Jurídico Español, desarrollando los diferentes aspectos objetivo, subjetivo y teleológico; el origen histórico de la prerrogativa, su desarrollo normativo en la Ley preconstitucional de 1912, así como su comparación respecto a otros Ordenamientos Jurídicos, lo cual ayudará a conformar un concepto más amplio y claro de la prerrogativa. Continuaremos analizando características, tanto procesales como de su contenido, y finalizaremos analizando las cuestiones relativas al origen y las causas de la crisis de esta figura en España, así como las diferentes propuestas de reforma del aforamiento parlamentario.

In the present work we will carry out an exhaustive analysis of the parliamentary prerogative of the defense of article 71.3 CE. We will begin by introducing this work through the differentiation of the three prerogatives that make up parliamentary status, before proceeding to place this prerogative in context, within the Spanish Legal System, developing the different objective, subjective and teleological aspects; the historical origin of the prerogative, its normative development in the pre-constitutional law of 1912, as well as its comparison with other legal systems, which will help to form a broader and clearer concept of the prerogative. We will continue analyzing characteristics, both procedural and of its content, and we will end by analyzing the issues related to the origin and causes of the crisis of this figure in Spain, as well as the different proposals for reform of parliamentary support.
