El Estatuto de la víctima del delito

Abstract

Los derechos de las víctimas del delito se han recogido por primera vez en España en único texto legal, la Ley 4/2015, de 27 de abril, norma sin precedentes en el derecho comparado que, a su vez, otorga amplias facultades a la víctima del delito durante la fase de ejecución de la pena. En el presente trabajo, se intentan explicar y abordar las principales cuestiones de esta Ley del Estatuto de la víctima del delito, desde su elaboración con el objetivo de transponer una directiva comunitaria hasta las controversias que se suscitaron y aún se suscitan en torno a ella.

The rights of the crime victims have been included for the first time in Spain in a single legal text, Law 4/2015, of April 27, an unprecedent rule in comparative law which, in turn, grants broad powers to the victim of the crime during the execution phase of the sentence. This paper attempts to explain and address the main issues of this Law of the Statute of the crime victim, from its elaboration with the objective of transposing a Community directive to the controversies that arose and still arise around it.
